New Colorado Law Regarding Level 2 Drug Felony For The Production Of Marijuana Concentrates Or Oils
Please be aware that as of July 1, 2015, it is now a level 2 drug felony under Colorado law to produce marijuana concentrates or oils using an inherently hazardous substance, unless you are licensed to manufacture medical or recreational concentrates through the MED. So all unlicensed production of BHO is now illegal. The statute defines "inherently hazardous substance" as "any liquid, chemical, compressed gas, or commercial product that has a flash point at lower than 38 degrees Fahrenheit, including butane, propane, and diethyl ether and excluding all forms of alcohol and ethanol." In other words, concentrates produced from water or alcohol extractions remain legal, but extractions using solvents or compressed gasses are now prohibited.
